The Jordanian Personal Status Law defines the categories entitled to maintenance. A wife is entitled to maintenance from her husband during a valid marriage under Article 59, even if she is wealthy, unless she is in nushūz under Article 62.
A divorced woman is entitled to ʿidda maintenance throughout her ʿidda under Articles 151 and 152. Children are entitled to support from a father of means under Article 187, continuing for sons until they can earn and for daughters until they marry, and the maintenance of a minor with no property is owed by his father.
Insolvent parents are entitled to maintenance from a solvent child under Article 197, and the maintenance of poor minors is owed by solvent relatives who would inherit from them, in proportion to their inheritance shares, under Article 198. All these entitlements are conditioned on need, ability, and the kinship relationship.
Assessing whether the conditions of entitlement are met for each category remains within the Sharia Court's competence on the facts of each case.
