Answer

Based on official Jordanian legal texts

According to Article 173 (المادة 173) of the Personal Status Law, the custody of a child by the mother continues until the child reaches fifteen years of age. For individuals other than the mother, custody continues until the child reaches eleven years of age. After reaching these ages, the child is given the choice to remain with the mother until reaching the age of majority. Additionally, if the child is suffering from an illness that requires the care of women, the custody by women may be extended unless the child's best interest dictates otherwise.

Frequently Asked Questions

Does the custody age differ between boys and girls?
The law sets a unified age in principle, but practice accounts for each child's needs. The judge has discretion based on the case.
Does the child have the right to choose?
Yes, after reaching the legal age. The choice is made before the judge in a special session, and the judge may override it if it conflicts with the child's interest.
Does custody continue beyond the age of majority?
Not by default. But for special-needs children, care may continue as needed, even if not legally called custody.
