Lineage & Paternity in Jordanian Law
Lineage, paternity and undocumented marriage in Jordan — Questions and answers based on official Jordanian law
Lineage (nasab) is the legal bond connecting a child to their father, and it is among the most consequential personal-status matters: maintenance, inheritance, custody, guardianship, and the child's name and official identity are all built on it. In Jordan these matters are governed by the Personal Status Law No. 15 of 2019, fall under the exclusive jurisdiction of the Sharia Courts for Muslims, and proceed under the Sharia procedural rules.
How lineage is established
Jordanian law recognizes the established routes of proof: the marital bed (firash) — a child born of a valid subsisting marriage is attributed to the husband without any lawsuit (the firash rule explained); acknowledgment (iqrar) by the father; and evidence (bayyina) before the court (conditions for proving lineage). In disputes, a lineage claim is filed before the Sharia court.
Undocumented and urfi marriage
The law requires official registration of marriage contracts and penalizes contracting without registration. Unregistered (urfi) marriages still occur, and the parties need a marriage-confirmation claim to secure their rights — above all the lineage of children born of an undocumented marriage. DNA testing
Courts use medical expertise and DNA testing as scientific evidence in lineage cases, within the recognized methods of proof and the court's assessment: Does DNA prove paternity? · Can the court order a test? · What if a party refuses?.
Denial of paternity and li'an
Conversely, the law and the courts construe denial-of-paternity claims narrowly to protect the stability of the child's lineage; denial is barred after acknowledgment, and li'an remains an exceptional, tightly bounded route.
The child's rights once lineage is established
An established lineage triggers the child's full rights: maintenance owed by the father, inheritance from him, the arrangement of custody and guardianship, and the child's civil-status registration. These effects connect with the alimony, inheritance, custody and guardianship topics.
When you need a lawyer
Lineage cases shape a child's legal position for life, and the outcome turns on evidence and the court's assessment. Where paternity is denied, evidence is complex, or medical expertise is needed, consider a paternity and undocumented-marriage lawyer in Jordan or book a consultation with Dr. Nadia Asaad.
