Answer
Based on official Jordanian legal texts
Enforcement of a maintenance judgment starts when there is an enforceable instrument, such as a final judgment, an expedited enforceable judgment, or a documented settlement that can be enforced. The creditor may file an enforcement request before the competent Sharia Enforcement Department, and the enforcement judge then supervises the steps needed to collect the awarded amount.
Under the Sharia Execution Law, enforcement may be connected to the place of residence of the creditor, the debtor, the court that issued the enforceable instrument, or the place where the debtor's assets are located. Article 4 deals with territorial enforcement jurisdiction. Article 5 gives the enforcement judge authority over enforcement disputes and measures such as attachment of assets, sale of attached assets, travel restriction, and detention where the legal requirements are met.
In practice, filing an enforcement case does not always mean immediate collection. The debtor may need to be notified, assets or salary may need to be identified, and the creditor may request available enforcement measures through the enforcement judge. Maintenance and related wages are treated with special importance because they are connected to living expenses and family support.
For that reason, a person seeking enforcement should prepare the judgment or enforceable document, the debtor's known address and information, and any available details about employment, salary, or assets, then follow the matter before the Sharia Enforcement Department or through a qualified lawyer.
This is a general explanation based on the approved Jordanian legal sources and does not replace advice from a qualified lawyer in a specific dispute.
